Motion

Section I

1.1 WHEREAS, the Student Conduct Code needs further improvement after some changes were made by the Senate in May 2014 and accepted by the University of Oregon Board of Trustees in September 2014, along with some temporary changes made by the Board without Senate consideration; and 

1.2 WHEREAS, some aspects of 2011 guidance from the Office of Civil Rights regarding conduct codes (seehttp://www2.ed.gov/about/offices/list/ocr/letters/colleague-201104.pdf, especially pages 8 and 12-13) have not been implemented; and

1.3 WHEREAS, the report by consultant Allen Groves regarding Title IX compliance and sexual assault (see http://senate.uoregon.edu/sites/senate.uoregon.edu/files/Groves%20Report_0.pdf) raised important issues; and

1.4 WHEREAS, the rights and interests of alleged victims of sexual assault have not been adequately spelled out in the current UO Student Conduct Code; and 

1.5 WHEREAS, there appears to be agreement from the Director of Student Conduct and Community Standards on several additional changes to the Code;

2.1 BE IT HEREBY MOVED that the proposals in the following attached memorandum be considered and voted upon by the Senate.

Financial Impact

Some possible impact on budgets to provide support for legal or other advisors for alleged victims of sexual assault.
